January 1, Federal appeals court upholds stay on Biden vaccine mandate
A federal appeals court has affirmed its stay on President Joe Biden’s vaccine mandate for companies with 100 or more employees.
The 5th US Circuit Court of Appeals said the mandate was “fatally flawed” and blocked the Occupational Safety and Health Administration (OSHA) from enforcing it “pending adequate judicial review” of a motion for a permanent injunction.
The ruling comes after the court issued a stay last Saturday. Last Monday, the Department of Justice requested that the appeals court lift the stay, saying it would “likely cost dozens or even hundreds of lives per day.”
The court said the mandate “fails to consider what is perhaps the most salient fact of all: the ongoing threat of COVID-19 is more dangerous to some employees than to other employees.”
“The Mandate is a one-size-fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers) that have more than a little bearing on workers’ varying degrees of susceptibility to the supposedly’ grave danger’ the Mandate purports to address,” the court wrote in its ruling.
Texas Attorney General Ken Paxton (R) filed the initial challenge to the mandate.
“WE WON!” Paxton tweeted. “Litigation will continue, but this is a massive victory for Texas & FREEDOM from Biden’s tyranny & lawlessness.”

Everything hidenbiden has done lately has been unconstitutional, this pathetic,embarrassing,failed,disgrace, doesn’t have a clue what being president is, he been a totally incompetent, failure in everything so far. He needs to be removed for being mentally unfit, to lead or govern. He has been the laughing stock of America and allies.Our adversaries laugh at him, because he is a spineless, weakling, who is afraid to stand up to anyone, they know they can roll over him.

Any political figure, esp the president, who spoils their bloomers in public is totally unfit and should be removed from office. Bidden is a total embarrassment to the Am ppl and we the ppl deserve better than listening to remarks about that and his farts. Why in the hell is this inept political hack still in office?? This dictator in the WH has issued 57 executive orders in less than a year. He has weaponized other agencies to do his unconstitutional bidding. It’s sad that a lot of the American people don’t know their constitutional rights, they would if they would read it. The Biden regime, does not go by the Constitution, they circumvent it at every angle. To them it’s just a piece of paper, not the laws of our Constitutional Republic! Like Pelosi said recently, the BBB plan was important to pass the Obama Agenda! This is the Build Back Better plan for illegals not the American people. Illegals take priority over us, it’s even in the infrastructure bill that the RINOS, sold our country out to. It never would of passed but 13 Republicans that never read the bill gave the socialists part of the next attached bill coming. Make your votes count in 2022! Save America!
